Introduction

These Terms of Service govern your use of Bit Bowerbird, a subscription-based platform operated by Bit Bowerbird, Roda de Barà, Tarragona, Spain (contact@thequietcode.com) that lets businesses create, manage, and publish their own professional websites. By creating an account or using the service, you agree to these Terms.

The Service

Bit Bowerbird provides website creation, hosting, custom domain support, content management tools, and related features. The service is provided on a subscription basis. We may update, improve, or modify features over time.

Accounts

You must provide accurate information when registering and keep your credentials confidential. You are responsible for all activity under your account. You can invite team members to manage your websites; you remain responsible for their use of your account. You must notify us promptly of any unauthorized access.

Subscriptions and Payments

Paid plans are billed through Stripe on a recurring basis (monthly, quarterly, or yearly, depending on the selected plan). Subscriptions renew automatically unless cancelled before the renewal date. You can cancel at any time from the billing portal: cancellation takes effect at the end of the current billing period, and your website will go offline after that date. Payments already made are non-refundable except where required by law. Prices may change with reasonable advance notice.

Your Content — Responsibility

You retain full ownership of the content you publish on your website (texts, images, prices, offers, contact details, and any other material). You are solely and exclusively responsible for all content you create, upload, edit, or publish through the platform. The operator does not review, approve, monitor, or control user content and assumes no responsibility or liability for it — including its accuracy, legality, or compliance with consumer, advertising, or sector-specific rules that apply to your business. Any claim, dispute, or legal action arising from the content of your website is your sole responsibility.

Acceptable Use

You may not use the service to publish content that is unlawful, defamatory, infringing, deceptive, or that violates third-party rights (including copyright, trademarks, privacy, or image rights). You may not use the platform for spam, phishing, malware distribution, or any activity that harms the service or other users. We may suspend or remove websites and accounts that breach these rules or that we are legally required to take down.

Hosting Provider Status

With respect to content published by customers on their websites, the operator acts as a hosting provider within the meaning of applicable EU law. We do not have general knowledge of or control over customer content, and we act expeditiously to disable access to content upon obtaining actual knowledge of its illegality (notice-and-action). Illegal content can be reported to contact@thequietcode.com.

Service Availability

We aim for high availability but do not guarantee uninterrupted service. Maintenance, updates, or circumstances beyond our control may cause temporary interruptions. We are not liable for downtime, data loss arising from causes outside our reasonable control, or loss of business resulting from service interruptions.

Intellectual Property

The Bit Bowerbird platform, software, brand, and documentation are the property of the operator. Your subscription grants you a limited, non-exclusive, non-transferable right to use the service. You may not copy, resell, or reverse engineer the platform except as permitted by law.

Limitation of Liability

To the maximum extent permitted by law, the operator shall not be liable for indirect or consequential damages, lost profits, or damages arising from the use or inability to use the service. Our total aggregate liability is limited to the amounts you paid us in the 12 months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

Termination

You may close your account at any time. We may suspend or terminate accounts that breach these Terms, fail to pay, or are required to be removed by law. Upon termination, your website is taken offline and your data is handled as described in our Privacy Policy.

Governing Law

These Terms are governed by the laws of Spain. Any dispute shall be subject to the jurisdiction of the competent Spanish courts, without prejudice to mandatory consumer protection rules that grant you the courts of your place of residence.

Changes to These Terms

We may update these Terms from time to time. Material changes will be notified on this page or by email with an updated revision date. Continued use of the service after changes take effect constitutes acceptance.
